The Judicial review of the An Bord Pleanála decision to grant permission to Larkin builders (Curvecco Ltd) to build 50 apartments in the grounds at Castlepark School has been withdrawn.
After just an hour into the judicial review proceedings, Judge Michael Twomey stopped the case and advised the applicants, the Lucey family, that they would face huge financial costs. He said a minimum four day hearing in the Commercial Court would cost €400k approximately as costs run at around €100k per day. Had proceedings run on a few days longer, costs for the court would have run up to a million euro. He advised the applicants to come to an agreement with the Larkin developers regarding the legal team costs. It was agreed to withdraw proceedings with conditions.
